Acceptance of Terms
By accessing or using WidgIq ("Service") at https://widgiq.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you ("User" or "you") and Gaurav Kumar("we", "us", or "our").
Description of Service
WidgIq is a developer-first SaaS platform that provides an embeddable AI chatbot widget SDK and analytics dashboard. The Service allows users to integrate AI-powered chat functionality into their websites and applications using our provided SDK and API.
Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.
Account Registration
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorized use of your account
- We reserve the right to terminate accounts that violate these Terms
Acceptable Use
Permitted Use
You may use the Service for lawful purposes in accordance with these Terms, including integrating the chatbot widget into your websites or applications and accessing the analytics dashboard.
Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of applicable laws
- Transmit harmful, offensive, defamatory, or infringing content through the Service
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to send spam, malware, or other malicious content
- Scrape or collect data from the Service using automated means without prior written permission
- Resell or sublicense the Service without our express written consent
- Interfere with or disrupt the integrity or performance of the Service
Intellectual Property
The Service, including its code, design, logos, trademarks, and content, is owned by Gaurav Kumar and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use it as described herein.
You retain ownership of any content you submit to the Service (e.g., website URLs, documents). By submitting content, you grant us a limited, non-exclusive license to process and store that content solely for the purpose of providing the Service to you.
API Key and SDK License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Use the WidgIq SDK to embed the chatbot widget on your websites or applications
- Access the WidgIq API using your assigned API key
This license is conditioned on your compliance with these Terms. We reserve the right to revoke API access for violations of these Terms or abuse of the Service.
Payments and Refunds
Pricing
WidgIq is offered at a one-time payment of $9 (USD) per workspace. Payment is processed securely by Dodo Payments. Prices are subject to change with reasonable notice.
Refund Policy
Due to the digital nature of the Service and immediate access upon purchase, all sales are final. We do not offer refunds except where required by applicable law. If you believe you have been charged in error, please contact us within 7 days of the charge at hello@widgiq.com.
Taxes
You are responsible for any applicable taxes, duties, or fees associated with your purchase.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
AI-generated responses from the chatbot widget are not guaranteed to be accurate, complete, or suitable for any particular purpose. You are responsible for reviewing and validating any AI outputs before relying on them.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GAURAV KUMAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless Gaurav Kumar from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.
Third-Party Services
The Service integrates with third-party services (e.g., Dodo Payments for payments, Firecrawl for crawling). Your use of such third-party services is governed by their respective terms and privacy policies. We are not responsible for the conduct of third-party service providers.
Service Modifications
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
Termination
We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. Sections 6, 9, 10, 11, and 15 shall survive termination.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Patna, Bihar, India.
For users in the EU: Nothing in these Terms limits your rights under applicable consumer protection laws in your country of residence.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
